    Getting Paid

    Hi everyone. Any independent BIM professionals out there? How frustrating is getting paid? My last invoice is 40 days old and my last one before that is 80 days old. Still no payment. What would you do? I've been turned into a starving artist and my MREs are running dangerously low.

    Did you have anything in your invoice about it going up after a certain amount of time? I'm not sure how it works with businesses, but I would look into a Lien against the one getting close to 80 days, as I think 90 days is the cutoff on when it can be filed. At least that is the rule here in Idaho.

        Did you set up expectations for when payments are due in your contract? So far I've only had one project where payment was late at all, and that was a complicated circumstance and I was kept in the loop the entire time.

        But I also wouldn't work for more than a few weeks without sending a progress invoice. Just my two cents though.

          Also, get with a lawyer to write you up a MSA (Master Service Agreement) between you and your recurring clients. This way expectations are set in advance on a general scale.

          Another thing... depending on who you work for, that matters. If you're working for a smaller client, well, maybe they don't have the floating capital to pay quickly themselves. Maybe they have a 45-60+ day billing cycle. Or if you do work for a very large company, they have a process since they have to run through so many POs and invoices so "get in line".

          These things needed to be set in advance, honestly. Not sure if they were or not, but you can't just "expect" them to know your financial situation and write a check the moment an invoice comes in, unless you clarify that.

            LOL! and you've been a sole proprietor for how long? Worked on your own without benefit of an employer for how long? I've noted the smiley face so I assume that your post was in jest. As one who has fought the "get paid" battle as a self employed business person since 1989 I find it difficult to fathom just driving up and getting a check. Anyway, on a lighter note: the way to get paid as a self employed business person is twofold. 1) only deal with reputable customers and 2) make your work untouchable (no one can provide your level of service at your level of value, anytime, anywhere, or anyhow). I get paid in less than 30 days from all of my customers without contracts, written agreements, etc. Because they know if they don't pay me, they lose me

              Not a sole proprietor... incorporated. Been a business owner (side business) for six years, but the past 7 months have been 100% on my own as an S-Corp with my wife as my partner. Looking to have enough in the bank within the next 4-5 months to drop the money for a lease space so I can hire 2-3 guys.

              My response was partly in jest, and partly 100% legit. I've had to do it before. It's a funny thing when a client needs something, they're quick to answer your calls to answer those questions to hurry the process, and quick to answer emails when it's a deliverable deadline is close. Get's pretty quiet when the they see the email or hear the voicemail that is "I am checking the status of invoice number XYZ".

              Again, I've had to do it. Walked right on in through the front doors at 7:15am, and the look on the PM's face was priceless. But, this particular company, was the ONLY company that has given me an issue to date. Most people in business will do the right thing, but he was sand baggin' for some reason. But I got my check, and drove 90mph to the bank named on the check just in case they tried something and CASHED it. Then went to my bank and paid off the loan on my truck.

              So, Dave, I'm happy for you that you have nothing but great clients. But sometimes things aren't always the case, and I know that you're one of the "stubborn" types... no offense but it's true - reality seems to only bend to your way of thinking sometimes. Look, there are times you gotta go get what's yours. Seriously... no joke. You think owners don't do this? My father has worked at the same mechanical contractor for 36 years and the owner (who he's great friends with, and has known me since I was born) has, on several occasions, drove to a client that owed money and demanded a check in excess of $250,000.

              And not sure where you were even going with the "how long" remarks. It takes me zero years, zero months, zero days and zero hours to come to the conclusion that someone needs to pay me.

              As Henry Hill on Goodfellas would say... "**** YOU. Pay me."

                I now know way more about you than I did before, thanks for the info. But, it's to bad that it took me ******* you off to get you to offer this great story and advice when for the OP all you had was "drive over and get the check". I know how to get the full story out of you now

                  Oh man, this reminds me of a good story. Hate to derail the thread, but I gotta get it out.

                  So I was 19 years old, swinging a duct hammer out in the field when I worked construction. Well when he did, I huffed and puffed and grabbed my tools, went to an area of work and started working like crazy.

He laughed and said "Tannar, you just did me a favor." I gave him the stink-eye, and asked "What the hell do you mean?" He said "Look, Tannar, now I know how to get your butt to work hard. All I gotta do is just tick you off. When you're mad at someone, you don't work harder, you drag your feet and kick rocks!!" After he hysterically stopped laughing, I couldn't help but to realize he was absolutely right and got in on the laughter.

                    Nice,..."you treat me square, I'll treat you square" is a good way to do business. Nothing personal, just business.
